OPEN ONLY TO LEGAL RESIDENTS OF THE STATE OF NORTH CAROLINA WHO ARE 18 YEARS OF AGE OR OLDER AND LOCATED IN THE FOLLOWING COUNTIES IN NORTH CAROLINA: WAKE, DURHAM, ORANGE, ONSLOW & NEW HANOVER. VOID ELSEWHERE AND WHEREVER PROHIBITED BY LAW. Eligibility: Open to legal residents of the State North Carolina who are 18 years of age or older, residing in the following counties: Wake, New Hanover, Onslow, Durham or Orange Counties. Employees, contractors, directors and officers of Building Blocks Publications (“Sponsor”), its parent subsidiary and affiliated companies, distributors, web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Giveaway, including, but not limited to, Building Blocks Publications, Inc (collectively, “Giveaway Parties”), and the immediate family members of each (spouse, parent, child, sibling, grandparent and spouse or “step” of each) and those living in their same household are not eligible. By entering the Giveaway, the winner consents to the use of his/her name, image, photographs, voice recordings and likeness by Sponsor without additional consideration or compensation, unless prohibited by law. By participating in the Giveaway entrants agree to be bound by these Official Rules and the decision of the judges which shall be final, binding and conclusive on all matters relating to this Giveaway. Giveaway Period: Giveaway begins at approximately 12:01 am (Eastern Time) on February 1, 2011 and ends at 11:59 (Eastern Time) on February 1, 2012. How to Enter: You may enter the giveaway by visiting www.buildingblocksusa.com (the “web site”) between the dates and times listed above. Fill out the giveaway entry form with all requested information and press the “submit” button. Only one entry per person per household and only entries submitted through the website will be accepted. Sponsor is not responsible for incomplete, lost, late, misdirected entries or for any failure to receive entries due to transmission errors or technical failures of any kind, including, without limitation, malfunction of any network, hardware, software, whether originating with sender or Sponsor. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion. Limit one entry per person, household and/or email address for the entire Giveaway Period. Sponsor reserves the right to hold an entry invalid for any reason, including but not limited to an invalid e-mail address given, incomplete or invalid information given on the entry form or failure to complete the entry form during the dates and times specified as the beginning and end of the Giveaway. Winner Selection: The winner will be selected by Sponsor at its office in a random drawing from all eligible entries received on or about February 1, 2012. The Grand Prize winner will be notified by overnight mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within fourteen (14) days of attempted notification. If the Grand Prize notification is returned as undeliverable or if required documents are not timely returned, winner will be disqualified, and the Grand Prize will be forfeited and awarded to an alternate by random drawing from remaining eligible entries. Grand Prize/Odds of Winning: One (1) Grand Prize winner will receive up to TWENTY THOUSAND DOLLARS ($20,000) credit toward the cost of a new home improvement project, including labor, materials, profit and overhead, contracted for with Sponsor. The Grand Prize is available only for new contracts entered into after the date of the drawing and may not be applied toward an existing contract or project with Sponsor. No cash refunds or credits will be issued for projects costing less than Twenty Thousand Dollars ($20,000). ODDS OF WINNING ARE BASED UPON THE NUMBER OF VALID ENTRIES RECEIVED. Limitations of Liability and Release: All entrants must have a valid e-mail address. No liability or responsibility is assumed by Sponsor or Giveaway Parties resulting from user’s participation in or attempt to participate in the Giveaway or download any information in connection with participating in the Giveaway. No responsibility or liability is assumed by the Sponsor or Giveaway Parties for technical problems or technical malfunction arising in connection with any of the following occurrences with may affect the operation of the Giveaway: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Giveaway, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Giveaway, or loss, miscount, misdirection, inaccessibility or unavailability of an Account used in connection with the Giveaway. Sponsor is not responsible for any typographical errors in the announcement of the Grand Prize or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. Sponsor and the Giveaway Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the Giveaway, use of the Web Site or the download of any information from the Web Site. By participating in the Giveaway, the entrant thereby releases Sponsor and Giveaway Parties, from any and all claims, damages or liabilities arising from or relating to such entrant’s participation in the Giveaway. By accepting a Prize, Winners agree that the Sponsor and Giveaway Parties shall not be liable for any loss or injury resulting from participation in the Giveaway or acceptance or use of the Grand Prize, including any travel related thereto. General: The winner is solely responsible for any taxes on the Grand Prize and will receive an IRS Form 1099 for the value of the Grand Prize. No cash equivalent or substitution of the Grand Prize is offered. No transfer of the Grand Prize is allowed. By participating, entrants agree to these Official Rules which are final and binding in all respects. If for any reason, the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Giveaway. This Giveaway is offered only in the State of North Carolina in the counties listed above and is governed by the laws of the state of North Carolina, and all claims must be resolved in the federal or state courts located in Raleigh, North Carolina, without regard to conflicts of laws principles.
